DMCA Policy

 

Introduction: theDailyHealthBlueprint.org ("Website") respects the intellectual property rights of others and expects its users to do the same. As such, we have adopted the following policy regarding copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA"). This policy outlines procedures for submitting notices of alleged copyright infringement and for our response to such notices.

Reporting Copyright Infringement: If you believe that content available on the Website infringes upon your copyright, you may submit a notification in writing to our designated Copyright Agent. Your notification must include the following information:

1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.

4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. Your physical or electronic signature.

Submitting a DMCA Notice: DMCA notices must be sent to through our Contact us page, email is preferred. theDailyHealthBlueprint.org, customerservice@yourdailyhealthblueprint.com.

Response to DMCA Notices: Upon receipt of a valid DMCA notice, we will promptly investigate the alleged infringement. If we determine that the content is infringing, we will remove or disable access to the material and take reasonable steps to notify the user who posted the content. We will also provide the user with an opportunity to submit a counter-notification if they believe the content was removed or disabled mistakenly.

Counter-Notification: If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated Copyright Agent. Your counter-notification must include the following information:

1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the Website may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

4. Your physical or electronic signature.

Submitting a Counter-Notification: Counter-notifications must be sent to our designated Copyright Agent using the contact information provided above.

Repeat Infringers: In accordance with our Terms of Service, we may terminate the accounts of users who are repeat infringers.
